"Non ticchettare bombe a orologeria": il tribunale israeliano si pronuncia contro le perquisizioni corporali invasive sulle donne del muro

Un tribunale di Gerusalemme ha stabilito che le donne affiliate al gruppo di preghiera femminista Women of the Wall non saranno più sottoposte ad alcuna perquisizione invasiva delle loro borse o dei loro corpi quando entrano nel luogo sacro ebraico, in un'importante vittoria per i sostenitori della preghiera pluralistica al Muro Occidentale.

"Continueremo a leggere dalla Torah, come è nostra prassi, al Muro Occidentale e a far risuonare una voce femminile lì e ovunque", ha promesso.
L'avvocato Uri Narov, direttore del dipartimento legale dell'IRAC, ha affermato che la decisione del tribunale ha dimostrato che fino ad ora la Western Wall Heritage Foundation aveva agito in violazione della legge, sottoponendo Women of the Wall a controlli di sicurezza particolarmente invasivi.
Yizhar Hess, vicepresidente dell'Organizzazione sionista mondiale ed ex direttore del movimento conservatore-Masorti in Israele, ha rilasciato la seguente risposta: "Per anni, il rabbino Shmuel Rabinowitz, che dirige la Western Wall Heritage Foundation, ha agito come se avesse un potere sovrano assoluto al Kotel come il Papa in Vaticano, arrivando al punto di inviare guardie di sicurezza dopo che i compagni ebrei venivano a pregare pacificamente. Il rabbino Gilad Kariv del partito laburista ha in diverse occasioni approfittato della sua immunità parlamentare per portare i rotoli della Torah nell'area per l'uso delle donne del muro da quando è stato eletto alla Knesset diversi anni fa. ‘Not Ticking Time Bombs’: Israeli Court Rules Against Invasive Body Searches of Women of the Wall

A Jerusalem court has ruled that worshippers affiliated with the feminist prayer group Women of the Wall will no longer be subjected to any invasive searches of their bags or bodies when entering the Jewish holy site, in an important victory for advocates of pluralistic prayer at the Western Wall.

Women participating in the monthly prayer service of Women of the Wall are often required to go through special searches at the checkpoints at the entrance to prevent the smuggling in of Torah scrolls.

The Western Wall Heritage Foundation – the Orthodox organization that administers the site – makes a large number of Torah scrolls available to men but not women, and therefore, on various occasions, worshippers affiliated with the group have brought Torah scrolls along with them in their bags and under their coats.

The Israel Religious Action Center – the advocacy arm of the Reform movement in Israel – took both the State of Israel and the Western Wall Heritage Foundation to court, on the grounds that such invasive searches were discriminatory and unjustified. At the urging of the court, the two sides reached an agreement that acquired the status of a judicial verdict on Wednesday.

According to the agreement, worshipers affiliated with Women of the Wall will not undergo any searches at the Western Wall beyond the usual security checks to which other visitors are subjected.

Welcoming the verdict, Anat Hoffman, the longstanding chairwoman of Women of the Wall, said: “it is about time that we stop being treated as ticking time bombs at the Western Wall.”

She called it “giant news” for supporters of religious freedom and women’s equality.

“We will continue reading from the Torah, as is our practice, at the Western Wall and to sound a female voice there and everywhere,” she vowed.

Attorney Ori Narov, director of the legal department at IRAC, said the court decision proved that until now, the Western Wall Heritage Foundation had been acting in violation of the law by subjecting Women of the Wall to especially invasive security checks.

Yizhar Hess, vice chairman of the World Zionist Organization and former director of the Conservative-Masorti movement in Israel, issued the following response: “For years, Rabbi Shmuel Rabinowitz, who heads the Western Wall Heritage Foundation, has acted as if he has absolute sovereign power at the Kotel like the Pope at the Vatican, going so far as to send security guards after fellow Jews coming to pray peacefully. The court has now put an end to this madness. This is great news for millions of women worldwide.”

The Western Wall Heritage Foundation said in response that the fact that Women of the Wall had not convinced the court to rule that banning Torah scrolls from the holy site was illegal meant that the group had failed in its suit.

Rabbi Gilad Kariv of the Labor Party has on several occasions taken advantage of his parliamentary immunity to bring Torah scrolls into the area for the use of Women of the Wall since he was elected to the Knesset several years ago. In such cases, he holds the Torah scroll for them, as security guards at the Western Wall do not allow him to pass it over to the women’s group.
